TERMS OF SERVICE

PAYMENTS

0.) This agreement outlines the relationship between the parties, wherein the Seller creates and delivers digital products-including but not limited to; NSFW audio, art, and funscripts at the request of the Buyer, who voluntarily purchases and receives said products.
1.) “Seller” refers to Umiko, the creator and distributor of the digital goods. “Buyer” refers to the individual or entity purchasing said goods. “Digital Goods” refers to non-tangible, downloadable or streamable content such as, but not limited to NSFW audio, scripts and illustrations.
2.) You, the customer, agree to pay the due amount upfront for any orders lower or equal to $35. On orders above $35, paying either $35 or half of the total commission value (whichever ends up more) is mandatory. The remaining amount has to be paid once the audio has been finalized.
3.) Any other payment schedule has to be mutually agreed upon before work on the audio starts.
4.) You accept that the recording process will not start until payment has been received.
5.) Certain types of work do not allow for split payment. In such cases, you will be informed about this and will be asked to agree on a different payment schedule before any work can progress.

DELIVERY

6.) You agree that the product will be delivered digitally to the email address provided by customer, once the final payment has been received by the seller.
7.) Any other method of delivery, whether it be digital or physical, has to be mutual agreed upon.
8a.) It is the sole responsibility of you, the customer, to propose a delivery method which works for both parties. The Seller cannot be held accountable for the customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles.
8b.) Upon delivery of the audio, It is your responsibility to store it properly. Loss of files due to negligence will not be reimbursed by The Seller, and cannot guarantee that the original copy of the product will be available in the case you lost your files.

REVISIONS

9.) Customer has the right to 1 (one) free revision.
10.) Such revisions may include; re-recording, pronunciation, volume, audio errors, or mixing changes.
11.) Any revisions that cause the project to lose significant progress require an additional fee.

CURRENCY CONVERSIONS

12.) You, the customer, agree to pay the total amount specified in USD.
13.) It is your sole responsibility to bear any currency conversion costs, bank transfer fees, and any other costs involved in transferring funds to the Seller.
14.) Payment is considered as received and completed only when the total amount received on the Seller's USD account is equal to the invoice amount in USD.

REFUND POLICY

15.) You, the customer, has the right to request a full refund if there's been no progress for two consecutive weeks, or when the commission has not been completed within two months. Refund conditions for commissions which require more work must be agreed separately, before work may start. these provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident, or any other credibly documented reason for interruption of work.
16a.) You, the customer, obliges to contact The Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress, etc.
16b.) Seller expects buyer to respond within a time period of maximum 4 days before moving on without feedback or further instructions.
17.) Lack of timely communication on the behalf of you, the customer, will be recognized as implicit approval of all work progress and current state of the project.

PERSONAL AND COMMERCIAL USE

18.) You, the customer, do not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
19.) In addition, you do not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.
